Study and Advocacy on Draft of Law 32/2004 Revision

Process of Law 32/2004 revision had been conducted for 5 years. Some institutions and civil society organizations focused on decentralization, local autonomy, local governments and local financial had joined Regional Autonomy Working Group (Kelompok Kerja Otonomi Daerah/ Pokja Otda) to assist and keep watching Law 32/2004 revision. Pokja Otda members are Komite Pemantau Pelaksanaan Otonomi Daerah (KPPOD), Forum Transparansi Anggaran (FITRA), Pusat Studi Hukum dan Kebijakan (PSHK), YAPPIKA, Urban and Regional Development Institute (URDI) dan Yayasan Inovasi Pemerintahan Daerah (YIPD).

The objectives was integrating concept and input to formulate draft of Law 32/ 2004 revision into three main topics: (1) National – Regional Interrelation and Authority, (2) Political Representation and Community Participation, and (3) Public Services and Regional Development.

Process of Law 32/ 2004 revision consisted of several activities:

1) Study Analysis

Study analysis was conducted by URDI to assess Regional Development Planning, Urban Areas, and Special Zone. Output for the study were policy brief for each issues and DIM of Draft of Law on Local Government proposed by Pokja Otda.

2) Public Consultation

Public Consultation was conducted to disseminate the study analysis results and to gain input from the community and various stakeholders. Public consultation was held in Western and Eastern Indonesia to obtain feedback and practical experience from Local Government and CSO associated with decentralization and regional autonomy issues.

3) Focus Group Discussion (FGD)

FGD aims was to gain strategic issues that need to be advocated in Law 32/2004 revision. FGD was held on March 15, 2013 at Hotel Salak Boutique The Heritage, Bogor and presented Nur Hidayati (Head of Advocacy and Campaign Department, WALHI), Roy Salam (Senior Researcher, IBC) and Iskandar Saharudin (Researcher, PATTIRO) as resource persons. Pokja Otda explained about Regional Innovation and Regional Finance. Then the resource persons explained about local authority for natural resources management, regional finance, and local governance particularly the provincial authority.

4) Media Briefing

Media Briefing was presented by URDI with theme “Local Development Planning” which held on April 14, 2013 at Bakoel Cofee Cikini, Jakarta. The briefing invited some mass media, such as Kompas, Tribunnews, Berita Satu. Wahyu Mulyana (URDI) explained that local development planning on the Draft was limited to procedural aspects, and less improvement on local government effectiveness and quality; because: (i) integration between planning and budgeting was less implemented that causing deviations on planning and implementation; (ii) lack of community participation; (iii) absence of measurable program priorities; and (iv) inconsistencies between local development planning and mayor programs.

5) National Public Consultation

Public Consultation was join cooperation between UNDP-PGSP, TIFA Foundation and Pokja Otda that held on April 23, 2013 in Harris Hotel, Jakarta. The aims of public consultation were: (i) explain Pokja Otda view on Draft of Law 32/2004 revision; and (ii) gained input and confirmed several issues related to Pokja Otda concerns. Public Consultation was a workshop discussed about Province Authority, Regional Finance, Development Planning, Public Service, Regional Innovation, and Regional Regulation.
